IMPORTANT! These Savoya® Rewards Program Rules (“Program Rules”) govern the Savoya Rewards Program (the “Program”) and your participation in the Program. These Program Rules constitute a binding agreement between you and Travel Research Advisors, LLC (“Savoya” OR “we” OR “us”).
PLEASE READ THESE PROGRAM RULES BEFORE PARTICIPATING IN THE PROGRAM, AS THEY AFFECT YOUR LEGAL RIGHTS AND OBLIGATIONS AND INCLUDE A BINDING CONFIDENTIAL ARBITRATION CLAUSE, A WAIVER OF YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, AND A WAIVER OF YOUR RIGHT TO A JURY TRIAL. BY ENROLLING OR PARTICIPATING IN THE PROGRAM, YOU ACCEPT AND AGREE TO BE BOUND BY THESE PROGRAM RULES. If you do not agree to these Program Rules, then you should not enroll or otherwise participate in the Program.
The Program is open by invitation only to Savoya customers who are legal residents of the fifty (50) United States and the District of Columbia and who are eighteen (18) years of age or older at the time of enrollment. Savoya customers who are employees of jet companies and Savoya customers who receive a discount greater than 10%, a commission, and/or a rebate are not eligible to enroll or participate in the Program. An invitation to enroll in the Program is intended for the specified individual only and is non-transferable. Corporations and other entities are not eligible to participate.
You may enroll in the Program by completing the enrollment process in the Savoya customer COREview Portal, which is available on the Savoya website at https://core.savoya.net (the “Savoya Site”) or in the Savoya mobile app (the “Savoya App”). The Savoya App is available for download at no charge from the Apple® App Store for iOS devices or the Google Play store for Android™ devices. You must have a pre-existing Savoya COREview account to enroll in the Program. If you do not have a Savoya COREview account, you may create one in the COREview Portal at no charge and without any purchase obligation.
You must provide all required enrollment information, including full name and email address. Additional required information may be identified during the enrollment process. Upon successful completion of Program enrollment, a Program account will be created (“Program Account”) and you will become a Program member (“Program Member”). Each Program Member is limited to a single Program Account and Savoya may elect to terminate duplicate Program Accounts. Only Program Members in good standing can participate in the Program. There is no charge to enroll or participate in the Program.
By enrolling in the Program, you are certifying that you meet all eligibility criteria. The Program is void where prohibited by law.
We reserve the right to modify, limit, restrict, or cancel the Program or any portion thereof (including the Program format, Program partners, Program elements, Point accrual, Rewards, and Reward levels) and/or to modify these Program Rules at any time in our sole discretion. YOU AGREE THAT WE MAY PROVIDE NOTICE OF MODIFICATIONS TO THESE PROGRAM RULES AND OTHER INFORMATION AND NOTICES RELATED TO THE PROGRAM BY ELECTRONIC MEANS, INCLUDING BY POSTING SUCH INFORMATION AND NOTICES ON THE SITE OR IN THE APP. If we make a change to these Program Rules that materially reduces your rights or increases your responsibilities, we will also notify you by email, so please keep your contact information current. Modified versions of the Program Rules will be posted at https://savoya.com/terms-rewards/ (or any other URL we may designate from time to time), together with a revised “Last updated” date. You should check this page periodically to see if any recent changes to the Program Rules have occurred. By participating in the Program after we post any such changes, you agree to the Program Rules as modified.
Savoya’s use of your information is governed by the Savoya Privacy Policy, which is incorporated by reference into these Program Rules. In addition, your use of our Services (as defined in the Savoya Terms and Conditions) in connection with the Program is subject to the Savoya Terms and Conditions, which are incorporated by reference into these Program Rules. To the extent of any conflict between the Privacy Policy and these Program Rules or the Terms and Conditions and these Program Rules, these Program Rules will prevail.
Savoya has engaged a third-party vendor, Incentive Solutions, Inc. (“ISI”), to manage portions of the Program, including hosting the website where Program Members can manage Program Accounts and redeem Points (the “Program Site”). ISI owns and controls the Program Site and your activity on the Program Site is subject to the ISI Privacy Policy, Terms of Use, and other documents and notices posted to the Program Site, including additional terms and conditions that may be specific to particular Rewards or classes of Rewards. ISI’s practices may differ from Savoya’s, so please carefully review all policies, documents, and notices posted to the Program Site.
Program Members can earn Program points (“Points”) as follows:
1. Program Members will earn one (1) Point for every US$1.00 dollar spent on Savoya ground transportation services, less (i) taxes and (ii) any discount, coupon, rebate, or other price adjustment. Points will not accrue, and may be deducted for, any cancellations, credits, refunds, chargebacks, bad debt, or voided transactions.
2. Program Members will earn Points on a one-time basis for the following activities:
3. From time to time Savoya may elect to award Points in connection with special offers or promotions. Such Points are offered or awarded in Savoya’s sole discretion and may not be offered or awarded to all Program Members. See each special offer or promotion for any specific terms, limitations, restrictions, or exclusions, including expiration dates.
Points will not be awarded retroactively. To earn Points for qualifying purchases or activities, you must be logged into your COREview account at the time of booking or, if booking with Savoya customer care by email, phone, or online chat features, present your Program Account number at the time of the purchase or activity.
Points for qualifying purchases and activities will typically appear in your Program Account within five (5) business days of your qualifying purchase or activity, as applicable. If you feel Points were not properly credited to your Program Account, you must notify us by contacting Savoya customer care at 1-866-916-3081 within thirty (30) days of the date on which the qualifying purchase or activity took place. You agree that our determination with respect to Points accrued shall be final. Points reflected in our records shall be deemed correct and we shall have the right to determine the Points to be awarded to you, consistent with these Program Rules, and to adjust or void Points at any time.
Your Program Account number is the same as your Savoya COREview account number. You are solely responsible for the accuracy and completeness of the information you supply in connection with your Program Account and for any activity under your Program Account or using your Program Account number. Please keep your login credentials secure and do not share them with others. Failure to keep your Program Account information current and complete may result in forfeiture or lapsing of Points, Rewards, special offers, and other Program Benefits. You may access and update your Program Account information and access your Program Account status, including Points accrued, online at the Program Site via the Profile page. Please note that updating your COREview account will not automatically update your Program Account, and each account will need to be updated individually. Program Members can also opt-in to receive paperless electronic statements of Points earned.
Except as otherwise provided herein, Points issued to Program Members don’t expire as long as the Program Member purchases Savoya ground transportation services at least once every twelve (12) months. If a Program Member fails to make such a purchase, all Points will expire one (1) year from the date of the last purchase.
Subject to these Program Rules, Points are available for redemption once they appear in your Program Account. Please visit the Program Site for the most up-to-date information on Program rewards (“Rewards”) and redemption information, including the available Rewards and the number of Points required to redeem a specific Reward. Program Members may redeem Points only for items listed on the Program Site at the designated Point quantities. All Rewards are available only to Program Members in good standing who have received Points as part of the Program. Reward items offered are subject to availability and may be changed at any time. We do not guarantee the availability of any Reward. We may stop delivery of a Reward after you’ve ordered it if your available Point balance falls below the number of Points needed to redeem the Reward for any reason, including refunds of purchases. Certain Rewards may be subject to additional terms, conditions, limitations, and restrictions. Please see the Program Site for details.
Points, Rewards, and other Program benefits: (i) have no cash value; (ii) cannot be exchanged for cash, in whole or in part; and (iii) have no value outside of the Program. The accumulation of Points does not entitle you to any vested rights with respect to Points, Rewards, or any other Program benefits. Points do not have a fixed cash equivalent and the “value” of Points may vary depending on the Reward chosen.
A Program Member’s Program Account, Points, Rewards, and all other Program benefits are for the use of the named Program Member only and cannot be sold, shared, assigned, bartered, or otherwise transferred.
You may terminate your Program Account at any time by contacting Savoya customer care at 1-866-916-3081. Savoya may terminate your Program Account and your participation in the Program at any time, with or without notice to you and without liability or obligation to you, if we determine, in our sole discretion, that (i) you are ineligible for the Program; (ii) you have violated these Program Rules, the Savoya Terms and Conditions, or any additional terms applicable to the Program; (iii) you have engaged in illegal or fraudulent conduct or conduct that is dangerous, deceptive, improper, or objectionable; or (iv) it is advisable to protect the interests of Savoya, our employees, customers, Program Members, or any third party. Immediately upon termination of your Program Account for any reason (other than cancellation of the Program), your membership in the Program terminates and all unused Points shall be void and forfeited immediately without notice or compensation.
In the event Savoya cancels the Program, your Program Account will automatically terminate. Program Members will have ninety (90) days from the effective date of Program cancellation to redeem unused Points for Rewards, but no additional Points will be awarded after the effective date of Program cancellation. Points not redeemed within ninety (90) days of Program cancellation will be forfeited without notice or compensation.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PROGRAM AND ALL RELATED PRODUCTS, SERVICES, AND PROGRAM REWARDS AND BENEFITS ARE PROVIDED “AS IS” WITHOUT ANY REPRESENTATION OR WARRANTY, EXPRESS, IMPLIED, OR STATUTORY, OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT, AND FITNESS FOR ANY PARTICULAR PURPOSE.
TO THE FULLEST EXTENT PERMITTED BY LAW, SAVOYA, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, UNDER ANY THEORY OF LAW OR EQUITY, WHETHER FOR BREACH OF CONTRACT, TORT OR OTHERWISE, ARISING FROM THE PROGRAM OR YOUR USE OF THE PROGRAM OR ANY PRODUCTS, SERVICES, OR PROGRAM REWARDS OR BENEFITS RELATED THERETO (INCLUDING MERCHANDISE, EVENT, AND TRAVEL REWARDS), INCLUDING DIRECT, INDIRECT, THIRD PARTY, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY THEREOF. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SAVOYA, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OWNERS, OFFICERS, EMPLOYEES, AND AGENTS, SHALL NOT BE RESPONSIBLE TO YOU OR ANY THIRD PARTY FOR OR IN CONNECTION WITH: (i) YOUR PARTICIPATION IN THE PROGRAM, (ii) YOUR USE OF ANY PRODUCTS, SERVICES, OR PROGRAM REWARDS OR BENEFITS RELATED TO THE PROGRAM (INCLUDING MERCHANDISE, EVENT, AND TRAVEL REWARDS), (iii) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR PROGRAM ACCOUNT OR UNAUTHORIZED USE OF YOUR PROGRAM REWARDS, (iv) LOST, STOLEN, OR DAMAGED REWARDS, OR (v) TERMINATION OF YOUR PROGRAM ACCOUNT OR CANCELLATION OF THE PROGRAM.
CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY.
We reserve the right, in our sole discretion, to adjust, postpone, or void your Points and Rewards at any time without notice, in the event of actual or suspected (i) human or technical errors; (ii) technical disruptions; or (iii) misconduct, fraud, or other activity (by you or by anyone) that impairs the administration, security, integrity, or proper use of the Program, any Program benefits, or any property of Savoya or its affiliates.
OU AND SAVOYA AGREE THAT ANY CLAIM OR DISPUTE AT LAW OR EQUITY THAT HAS ARISEN OR MAY ARISE BETWEEN US IN CONNECTION WITH THE PROGRAM WILL BE RESOLVED IN ACCORDANCE WITH THE PROVISIONS SET FORTH IN THIS SECTION AND THE FOLLOWING SECTION ON PROHIBITION OF NON-INDIVIDUALIZED AND REPRESENTATIVE ACTIONS. PLEASE READ THESE SECTIONS CAREFULLY. THEY AFFECT YOUR RIGHTS AND WILL IMPACT HOW CLAIMS YOU AND SAVOYA HAVE AGAINST EACH OTHER ARE RESOLVED.
You and Savoya agree that any and all disputes or claims that have arisen or may arise between you and Savoya in connection with the Program shall be resolved exclusively through confidential, final, and binding arbitration. YOU ARE GIVING UP THE RIGHT TO LITIGATE A DISPUTE IN COURT BEFORE A JUDGE OR JURY. The arbitration will be conducted by the American Arbitration Association (“AAA”) or any successor entity under its rules and procedures governing commercial disputes (or the AAA’s Supplementary Procedures for Consumer-Related Disputes, for Program Members who established and use a Program Account solely for their own personal, non-business-related travel), as modified by this Agreement to Arbitrate. The AAA’s rules and a form for initiating arbitration proceedings are available on the AAA’s website at: www.adr.org.
The arbitration shall be held in the county in which you reside or at another mutually agreed location. If the value of the relief sought is $10,000 or less, either you or Savoya may elect to have the arbitration conducted by telephone or based solely on written submissions, which election shall be binding on the other party subject to the arbitrator’s discretion to require an in-person hearing if the circumstances warrant. Attendance at an in-person hearing may be made by telephone, unless the arbitrator requires otherwise.
The arbitrator will decide the substance of all claims in accordance with the laws of the State of Texas, including recognized principles of equity, and will honor all claims of privilege recognized by law. The arbitrator’s award shall be confidential, final, and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s rules.
You and Savoya agree that each of us may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding. Unless both you and Savoya agree otherwise, the arbitrator may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding. Also, the arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party’s individual claim(s). Any relief awarded cannot affect other Program Members. YOU ARE GIVING UP THE RIGHT TO COMMENCE OR PARTICIPATE IN CLASS AND REPRESENTATIVE ACTIONS.
Savoya and/or its affiliates may send you email communications, including promotional communications, related to our services, our affiliates’ services, and the Program. You may opt out of receiving future promotional emails from us by following the unsubscribe link in any promotional email we send you. Please note that even if you choose to unsubscribe from promotional emails from Savoya, we will still continue to send you transactional emails regarding our services and the Program.
Applicable Law: Subject to Sections 11 and 12 above, the laws of the State of Texas, without regard to principles of conflict of laws, will govern the Program and any claim or dispute that has arisen or may arise between you and Savoya.
Taxes: Program Members are solely responsible for any federal, state, or local taxes and/or government fees that may be imposed in connection with the Program, including all Rewards. An IRS form 1099 will be provided to Program Members for each year in which the Program Member redeems Points for Rewards with a combined fair market value of $600 or more. It is suggested that each Program Member consult a tax advisor in regard to reporting the Program benefits for income tax purposes.
Waiver: No delay or failure by Savoya to enforce any of these Program Rules shall be a waiver of any of our rights under these Program Rules.
Severability: The invalidity or unenforceability of any provision(s) of these Program Rules shall not affect the validity or enforceability of any other provision. In the event that any provision of these Program Rules is found to be invalid or unenforceable, the parties shall in good faith modify or alter the remainder of the Program Rules to effectuate the original intent of the parties.
Construction: The headings used in these Program Rules are for convenience only, are not a part of this agreement, and do not affect the interpretation of any of the provisions of these Program Rules. Any reference to the term “including” means “including, without limitation.” All references to currency are stated in United States dollars. In all matters relating to the interpretation and application of the Program Rules, the decisions of Savoya will be final.
Force Majeure: Savoya shall not be liable for any failures or delays in performance arising from acts of God, acts of civil or military authority, acts of public enemy, war, riots, civil disturbances, insurrections, accidents, theft, malicious damage, fire, explosions, natural disasters or the elements, strikes, labor disputes or any other causes beyond the reasonable control of Savoya.
Survival: The provisions regarding disclaimer of warranties, limitation of liability, arbitration agreement, prohibition of class and representative actions and non-individualized relief, and these miscellaneous provisions shall survive termination of your Program Account or cancellation of the Program.
